Section 21 Query

Served a s21 notice to tenant (London Borough of Redbridge). The County Court was Romford.

Timelines:

  • February 2025 - s.21 served -
  • April 2025 - Accelerated Possession Order (application sent to county court)
  • May 2025 - Notice of issue received from County Court
  • May 2025 - 14 day period lapsed to inform County court no defence has been filed/tenant not vacated property
  • June 2025 - Possession Order granted (tenant has to vacate by 30 June 2025)
  • July 2025 - Application for Bailiffs submitted to County Court (warrant for posession)

Will update timelines once/confirmations received of a bailiff being appointed (I understand there is a backlog so this could be several months)

Question: When the possession order was granted it stated the tenant has to pay the claimant costs by 30 June 2025. The tenant has not paid this (and I assume will not, which I had factored in already so was prepared to take the hit). Out of curiosity what would be the process to try and reclaim this - I am assuming via the courts again.

Has anyone had experience attempting to do this and can share their experiences (is it worth the hassle?) For now the tenant has still continued to pay rent monthly (relatively on time - which i think nowadays is a big win for any landlord serving a s.21) which is why I do not mind about the court costs per se - but still wanted to understand the process.

wow, thanks for sharing the process and timelines. What a nightmare and additional cost, can't imagine how much worse it would be with the RRB.

You are fortunate tenant is still paying rent. Best of luck with the process and finally getting posession !

MCOL , yes worth the hassle.

Also upgrade to high court bailiffs for a faster eviction. Tack the extra cost to the above claim.
