If a S21 is issued but I decide not to proceed and it simply expires, do I need to draft another AST or is the existing one still valid?

Does a S21 essentially nullify an AST?

No. The existing AST continues, though it might be a good idea to renew the tenancy once the existing AST expires.

Thanks, that's what I thought.

I have a tenant with arrears who's on UC and I issued a S21 6 months ago. We agreed a payment plan that's working so I've let the S21 expire. (I didn't do S8 for reasons).

The tenant has agreed to ask UC to increase the direct payments but they won't without a current AST, hence my question...

There's still a current AST. They shouldn't be refusing it just because a tenancy has continued on in to a periodic term (for which a new agreement would never be issued, nor is it needed).
