Repeated problems with reluctant co-landlord; deadline to increase rent in 3 weeks, how to proceed - if required - alone?

Hi all,

I’m a co-landlord of a property in the UK, and we’ve been renting it out for years at below-market rates. The tenancy anniversary is at the end of June, which means we need to notify our tenants of any rent increase by the end of May.

The problem is: my co-landlord isn’t engaging with me about this at all. They’ve shown little to no interest in discussing a rent increase, and time is ticking. I’m frustrated by the delay and wondering how to proceed—ideally legally and properly—on my own if I get no response.

Can I issue the rent increase unilaterally? What steps should I take to ensure I’m not in breach of any rules or agreements?

You should have signed a Joint Venture agreement with the 3rd party, to avoid disputes like this and have a clear line for decision making.

If you’ve been managing the property (e.g., collecting rent, dealing with the tenant) and the other owner has not objected, courts may infer that you have implied authority to continue managing, including making decisions like rent increases.

When you say not engaging, as not wanting to increase rent, not responsive, or doesn’t want to discuss this topic?

Either way - I’d send a letter/email highlighting the deadline and that you believe a rent increase is needed to align with the market. Phrase it that you will proceed with it if you don’t get an objection within 14 days.

Yes letter that outlines the increase amount from and to, reason and 14 days to respond.
