Hi got judgement from court after section 8 and 8100 is due against tenant. However they are being evasive (whilst working in reputable institution, if referencing is correct) How to enforce that money, tips appreciated. Any recommended services/tracing ?
I understand you can get a court make to make an attachment of earnings . I haven't done it, but I understand it can be done.
Is that something handled by enforcement agencies or me?
If they have just vacated you may want to wait a little while, then engage a Tracing Service to find the tenants new details.
Then you want to ask a solicitor what to do next.
You could apply to the court for an "attatchment of earnings" to get paid that way bit by bit, you could apply to the court for an charging order if they or guarantor own any other property, you could ask the court for a Warrant of Control (Bailiffs) to visit the debtor’s home or business to seize goods to sell at auction, you could get a "Third Party Debt Order" this freezes money in the debtor’s bank or building society account and orders it to be paid to you.
If the debt is over £5,000, you could petition for the debtor’s bankruptcy
