Tenant looking for some perspective. Am I in the wrong?

Hi there. I've been a tenant with my current landlord for 3 years. I've finally saved up and have purchased my own home. I gave my 1 month notice a couple of weeks ago and it ends early/mid April. I have movedost ofy things into my new home, but still need to clean. As I have a couple of weeks left of my tenancy this is ideal. It means I can take my time and clean it well.

However, since I gave my notice, the landlord has been badgering me to clean it immediately. I was under the impression that as I have paid for this month and am still under contract that I could literally leave it until the last day to clean if I really wanted to?

Yesterday I went round to clean and found that the landlord had been in, without giving me any heads-up/24 hour notice, and had turned off the fridge freezer. They left the doors open and the ice from the freezer melted and poured out onto the kitchen floor. I sent a message asking if they had been in an unplugged it, and if so why. Then we had the following back and forth.

Am I totally in the wrong here? I'm just a tad baffled.

Landlord shouldn’t be entering without your permission whilst still under tenancy. It’s still your property, the only sticking point I could see is insurance would be void if vacant for more than 30 days, which I doubt it will be. But yeah, they are been an arse. When it comes to a proper check out, and notifying council tax etc, tell them the landlord apparently took back control a month early, they can pay the bills from the point they feel it was there’s again.

You are completely in the right. I would imagine the landlord is going to try and sting you for your deposit too for “cleaning” etc. Make sure you take photos of everything before handing the keys back. Even better if you have photos of the place when you first moved in.

I agree with the above poster, if you can get it in writing the date he things you no longer became a tenant at the property, that’s the date you can give to all suppliers, council tax etc.

No don't you dare. You hand those keys back on the LAST day of your paid tenancy. And don't strain yourself too much to clean. Just fulfil the contract and nothing more. Take pictures. Those and these screenshots would be of great interest to the Deposit Scheme people, should there be a delay in releasing your deposit.

The landlord takes over when the tenancy ends, not some random point in time. Do not hand the keys back before it ends. Do not inform the council/energy companies until the day the tenancy ends.

The landlord turning the fridge freezer off was stupidity … of course it’s going to defrost and leak water everywhere.

Makes sure you keep this conversation as evidence for your deposit counter claims.

He is definitely being an ass here. The only thing I can think with from his perspective is that he probably wants to show prospective tenants round so he can get it rented again as soon as possible… hence the desire from him to have it looking clean right away.

Technically yes you can wait until the very last day to clean and you can leave boxes lying around wherever you like… as you as still paying for the right to have exclusive use over the property. If he was a little nicer he might coordinate the transition with you and if it were me I’d offer to do some cleaning for you in exchange for letting me show people round early… but that would be entirely up to you as to whether or not that was acceptable.

I once had a landlord that not only entered our property whilst we were still under contract but started PACKING our stuff away (and ruining it), too.

He had the audacity to try and claim for damage to the property (there was no damage). Thankfully, I took photos on our moving in day.

Some landlords are assholes.

I had a landlord who tried to do the inspection before we cleaned because we paid for two flats for the crossover month. 

I arrived with cleaning materials to find him and his assistant wandering around making notes. 

He actually sued us for damages that neither of us could prove who caused, and the judge basically sighed and said split the costs 50:50 or I'll make it more expensive for both sides (not exactly but the gist).

I was too naive to have asked the judge to clarify rules for entering a property without asking or permission and doing an inspection without tenants present.

Yep. I had a similar issue, weren't even a day into moving things to the new house, still a month left on tenancy, in come builders and landlady strutting about wanting to renovate start pulling stuff down. My girlfriend and I took our stuff and turned off all the facilities and left. No point cleaning. Builders were in. Interestingly, when I told power company we were out, they turned off the power, remotely with the smart meter. Ha.

You should report him to your local authority/council - they'll have somewhere to report "rogue" landlords. By entering without notice nor your permission, he has breached your right to quiet enjoyment, which is an essential element of all leases. Further, entering without your permission, and his messages, could amount to tenant harassment - see protection from eviction act 1977. Even if the council don't do anything, he's on their radar and a second report by someone else might provoke action.

He may have entered in order to take photos before you moved out to use against you so he can claim more of the deposit. Make sure you take lots of photos of how you leave the place and video too e.g. of things working etc.. Once you move out, if says he wants you to agree to deductions - ask him for the photos he's relying on and look at the meta data, or compare them with yours. Then refuse to agree any deductions. At that point, you can use the tenancy deposit protection scheme to arbitrate the dispute but importantly he will have to prove his right to deduct and the value proposed is warranted, before the Scheme authorises any deductions.

If he's used photos from his unlawful entry to try and get either you to agree deposit deductions and/or submitted them to the Scheme during arbitration, you should sue him in small claims court for money (pick a figure under £10k, which is the small claims limit) for (i) breach of your right to quiet enjoyment (ii) trespass (iii) harassment ((a) general and as a (b) tenant in particular because he sent the photos to you to get you to agree to deductions rather than going through the deposit scheme) (iii) fraud by misrepresentation. Set out all the facts, including typing out the dates/times of messages and their contents, and detail how you felt harassed/anxious, any extra work you had to do because he turned off things etc, and/or anxiety/extra work because he sent the photos from that illegal entry to you and/or the deposit scheme.

Well I'm hoping they don't have a leg to stand on. We have to leave the place as we found it, but the LL never actually saw how we received it. We got the keys from the old tenant, presumably because the LL didn't want to have to do anything in the interim, and never provided an inventory. I asked the old tenant and have written confirmation from them that the only time the LL went in was to show people round 3 weeks before he moved out

The deposit is an an official scheme through OpenRent. I took a load of inventory pictures when I first got in there, but the LL never wanted them. Never came round to see how we received it either.

You don’t need to prove the damage was there when you moved in - the landlord has to prove it wasn’t. Without any sort of inventory that’s impossible so there’s nothing to argue about.

I've been through this, where a landlord didn't take an inventory when we moved out. He tried to claim thousands of pounds. The finding agents had done us a solid and put the deposit in a protection scheme, mercifully.

It had to be reviewed, but we ended up getting the full deposit returned to us.

The burden of proof is with the landlord, so if there's no inventory, they can't claim a penny from you.

Apart from your landlord is blatantly breaching the AST Agreement, make sure your deposit has been protected. If it hasn't, congratulations, you've made the easiest money you'll ever make!

Even if it is protected, with no inventory, the landlord won't be able to argue anything for damages.

Absolutely not, that property is yours until the end of your tenancy. None of your tenants rights change just because you have given notice.

The landlord letting themselves in before your tenancy is up is not just out of order, it is illegal and puts him in violation of your renters rights and tenancy agreement.

The landlord’s communication is disgusting! They have no right to be in the property whilst you’re under contract. Your communication to him was completely professional. Please make sure you take photos of everything and a video as this will help you pick up on anything missed by the pictures.

As the landlord is acting this way it is likely they will try and deduct fees for cleaning etc. Don’t agree to any deductions if they are presented and let the deposit scheme deal with it.

My previous landlord (great guy) asked me for permission to access the vacated property that we had rent paid until end of the month although we left 15 days earlier.

He then asked if I wanted 15 days money back as he was gonna do work on the property. We signed an agreement and ended earlier. He gave us the rent money back, deposit (minus some minor for damage he already knew about and we agreed beforehand)

If you want to really stick it to him, keep a key (get a new one cut), enter the property after the tenancy has officially ended and turn all the appliances on. He will be footing the bill. You don’t seem the vindictive type, but sometimes just knowing you “could” do that, helps you feel better.

Set up a remote camera. Film if they continue to enter and then you have evidence of potential harassment as you are entitled to quiet enjoyment until the LL takes possession.

As they are a twt, and I imagine wanting karma might be tempting, I’d recommend looking closely at the dates your deposit was protected. Our LL also turned into an twt and as they didn’t protect our deposit within 30 days, they’ll be getting a letter before action once we are out. FAFO 🤷‍♀️

If he wants you out earlier I would ask for a portion of your rent back. Mind you turning off the appliances would ultimately save you electrical charges (not much) plus gets you off the council tax sooner rather than later.

Had this exact same thing happen to me after giving notice and paid for an extra month's tenancy, as I was moving 500 miles from southern England to Scotland, and needed additional time for travelling between old and new house before the actual moving day.

Went away for a weekend the day after I gave notice, having mentioned to the letting agent that I was going away for a couple of days, just in conversation as we had a friendly relationship.

I came back to find they had been in the house showing prospective new tenants around, and had the audacity to email me asking where the original curtains were (I'd stashed them safely away and used my own curtains) and commenting that my cat, for whom I had express permission to have in the property, had made some light scratches on the upstairs banister which I would need to remedy at my own expense.

That was a given, no problem at all - what I had a problem with was, I was still the tenant and they had no right to come in without even informing me, let alone actually asking if that would be okay. To say I was furious doesn't even come close!

So, stand your ground, legally you are in the right for as long as your tenancy holds.

It is reasonable to expect that new prospective tenants might need to view the place before you move out, but the landlord can only enter the property with your consent while your tenancy is still valid - AND they need to give at least 24 hours notice if they want to bring people in for viewing.

Don’t hand over the keys until the end of the agreement. Make sure they aren’t coming in the property while your AST is still valid.

If they want to take possession of the property earlier tell them you’ll be happy to surrender the remainder of the lease for a refund in some of the rent.

Make sure you take meter readings now, and again when you leave.

I would be changing the locks, telling the LL that they have broken the law in entering the property as you enjoy quiet enjoyment. I would then be giving the keys back on the very last day, they want to get in early to take photos and list it sooner, don't give them a leg up.

It's your home. You're paying the rent on it. As a landlord we give 24 hours' notice to enter and get permission. It sounds like he switched off appliances that you're running and paying to power. Crazy antics on their part. It's fairly cut and dried - is it your home still or have you left and it's now under the landlord's control? I assume it still is your home so he's completely out of order.

If the landlord is entering the property while you are still living there under a tenancy agreement and paying rent, without giving notice, they are trespassing. The fact that he owns the property is irrelevant as it's your home while the tenancy contract is in force and you have a legal right to quiet enjoyment of that home without being harassed.

Call the police (non-emergency number) and file a report.

The bright side this will soon be behind you since you purchased your own home now. Strangely my last few days in my corporate owned apartment was worse than individual mom/pop rentals. My own landlord cried and tried to vacate my house less than 2 months after signing a 3 year lease. Why? His married daughter sold her own house and wanted a temporary home for her family. My corporate owned apartment was almost twice in rent and I got a third of the space. The landlord is simply trying to get it cleaned and turned around to rend during your time so they can reset it.

Simply state that they can not touch or switch anything until the day your lease ends or you will be seeking legal advice.

it will depend on where you live. some laws allow for last paid month for the landlord to be barging in for safety reasons, but most of it has to do with the house being empty.

If you still have your stuff in there and paid your month, you are free.

if your stuff is not there, it's worth checking the local laws. most won't allow them to barge in.

We got a payout, they changed their attitude towards tenants they have at many properties they owned and now properly maintain those properties and respect tenants out of understanding it could happen to them again

You need to assert your rights better as not doing so allows others to take a mile.

In this situation you should have been holding your ground in the convo but also asserting your legal rights as a tenant and just bluntly advising if the LL conduct continues you will be forced to take action for the breaches of rights a tenant has.

Honestly the LL seems like a narc and behaves totally as if they get to call the shots at all times and then try to put you in your place when you have the rights.

I'd seriously have some fun with this LL before I moved out if it were me and I'd leave them tied up in issues long after I moved out - all self-inflicted by LL.

All the best OP and I hope they next tenant this LL gets is an absolute nightmare.

Property manager here. A landlord who lets themselves in without giving you written notice is committing as much of a crime as a criminal breaking into your home.

If you feel strongly about your landlord letting himself in, report it to the police. Not sure what they'll do since I've never had to deal with that, but I imagine they'll want his evidence of giving you notice.

For the future, I’d try to be less emotional. The least amount of details you give, the less people have to go on to criticise you or annoy you. You should have said: “Hi Landlord, as per our contract, my tenancy only ends on X/04/25. The property has not been vacated, and I’d just like to remind you that any visits to the property need to be informed 24 hours before and agreed upon. Please refrain from breaching any contract rules. Thank you”.

If he replies “blah blah it has been vacated” just go “it appears there’s a miscommunication, the property has not been vacated”. And let him talk to himself. You have answered all questions.

Sometimes we extend the bullshit and give ammo to assholes because we feel that their concern is legitimate - but many times, it just isn’t. Don’t legitimise bullshit.

They should not be entering the property without warning, and if they do show up without warning, should absolutely not be entering without your being there.
The could have taken and done anything (which they did). They had no right to turn off the freezer, especially if there were still items in them, and no right to remove items that weren't theirs.

Take photos of everything, before and after whenever you can, and then if they try to deny you your deposit back because of damages, you have proof that it wasn't you.

You could actually sue if they're accessing the property without advance notice, especially if there's a time frame in your tenancy agreement, the usual legal frame is minimum 24 hours notice.

They could also be on the hook for any groceries that were ruined by them unplugging the fridge that you had to replace. I'd keep records for the next few weeks and carefully consider looking at legal routes.

Yeah, if your landlord has given you a notice/vice-versa, it's your rental property until the second that's over, not before.

If you choose to hand over your keys early, and vacate the property early, that's fine. It's up to you. But if you want to wait until the very last second, then you do that.

I had a similar situation to this where I moved and had a place effectively vacated for 2 months. However, I kept my keys because it was right in the centre of town, among all the shops (it was actually above a shop) and a real relief if you wanted to pee while out and about in-town, and it was furnished so I crashed there a couple of times during big nights out.

The landlord did actually complain to me in a similar fashion, but I told her if she wanted the keys earlier, I'd be happy to give them to her - in exchange for a pro rata refund of the rent. She shut up when I said that.
