Periodic Tenancy - 6 Months Up Front

My tenants 6 month fixed term AST ends at the end of March, then they will be on a month by month periodic tenancy.

Today, they have asked me if they can pay 6 months up front again.

Fine by me — but are there any implications to this? Considering it is now periodic?

Just get a new/revised tenancy agreement written up.

Ah, is it that simple, thanks! I wasn’t sure if the abolishment of ASTs would affect this, but doesn’t look like it’s in place yet

Just be really careful in defining the rental period in your contract. In periodic tenancy the notice needed to end the tenancy dependends on the period the rent is due in, and the rental period also impacts on how much notice you need to give when proposing rent increase. Obviously the tenant paying the rent upfront doesn't automatically change the rental period to six monthly but if the contract is vague and the tenant keeps doing this for few years it might be easier for them to argue the rental period is six months.

Thanks for the info - is this still the case if I put together a new AST for 6 months? I think this is the cleanest way of doing it

It may or may not apply in your case but why exactly are they wanting to do this. Cannabis farm, brothel etc - often want to be left alone and it suits them to pay up front

Yeah fair point - but have inspected previously with no issues - recommended from a letting agent having been a tenant previously. Don’t think that’s the case here
