Section 21 - no EPC at commencement of tenancy

Hello all,

I need to evict tenants as they have stopped paying rent. It has only been one month since they have stopped but they have shown that they are not looking to pay going forwards.

When the tenancy commenced, I had a valid gas and electric certificate however did not have a EPC on the property (kicking myself). I have now got the EPC sorted with a rating of C.

Would the section 21 be valid as I did not have a EPC at the time of the tenancy commencing?

EPC requirements

Under The Energy Performance of Buildings (England and Wales) Regulations 2012, landlords must give a copy of a valid energy performance certificate (EPC) to the tenant before the section 21 notice is served. No time limit is specified for this purpose. 

The EPC can be given to the tenant at any point before the section 21 notice is served.

Do you need to explicit provide this while anyone can access it at https://www.gov.uk/find-energy-certificate Assuming there is one for the property
