Hi all, we currently have an issue with management company not communicating with us or sending us rent. we are awaiting over 7 rents but nothing paid. This is often the case with no communication. There is a few issues id like some advice on.
You seem to be talking about management agent in a block of flats? Have you purchased the flats, or taken over right to manage? I presume instead of rents you mean Ground Rent and Service Charges?
The first thing i'd be doing is talking to a solicitor. As is norm service charges/ground rent are paid annualy (not monthly) and is held in a Client Deposit account as a legal requirement. You would need a Client Deposit Account also if your taking over management.
we own the freehold and the flats so there is no service charge or ground rent.
Ah, so not management agent but you are talking about a Lettings Agent?
Have you just bought it? You could start legal action against the previous owner, it's they who the agent acts for. However your conveyancer should have sorted all this out when you purchased them.
In the meantime, visit the tenants and give them your new bank details (or that of your new agent).
You can check the agent is part of any scheme? Like the PRS
