(Scotland) Any landlords been through the first tier tribunal eviction process recently?

Hello,

I am based in Scotland - Are there any landlords here that have been through the first tier tribunal eviction process as of recent?

I submitted an application to evict a tenant that has refused to leave since their eviction date, which was the end of June but I am yet to hear back regarding any tribunal dates (or even any correspondence to say my application has been accepted).

I'm aware there is most likely a backlog since the rent cap in April but I am wondering how long I can expect to wait for a response to my application? It has already been nearly 5 months.

No answer to your question but it got me thinking after recent dealings with the NHS, I wonder how far away we are from a 'private' justice system where you can pay an extra thousand or two £ and have your case heard at the weekend (and in a commercially reasonable amount of time)

You should have received an acknowledgement from the Tribunal with your case reference number within a couple of days of making your application. If you didn't get this you need to email or call the Tribunal.

Otherwise you could reasonably expect an application to complete 'sifting' in about four to six weeks, followed by 'review' (by a legally qualified member of the tribunal) in another four to six weeks, followed by 'acceptance' and the scheduling of a Case Management Discussion within about three months.

If you haven't heard anything in five months that would indicate a problem to me. You should have at least received confirmation that your case was going to CMD by now.
