Putting in your notice to leave?

Hi all ,

After my rent has just been increased and some personal family matters I have decided for the short term to move back to my mums as my mother has a terminal condition and I work from home.

I am hoping to put my notice in tomorrow, when it says one calender month, i have a few questions

Do I put my notice in now and pay the Increased rent for a whole month cover the whole of November?

Do I put my notice in now and just pay for the 2 weeks and 1 day of November that I will live there for?

Do I pay the increased amount or my contracted amount that I currently pay?

Ultimately because of the rent increase of £300 a month and family matters I have not accepted the rent increase and therefore will leave and he can get Tennants in that can or want to pay the larger amount.

I am not trying to skimp on paying the correct rent , I have no issues in paying the new full increased amount if that is required.

I want to be a respectable Tennant for the future but I have never put in notice to leave before , so I have no idea what the normal process is in these circumstances.

Have you been served with a formal rent increase notice under section 13 of the Housing Act?

When did you get given the formal increase notice? (I'm asking to check that they gave you enough notice).

You'd normally give notice so it ends on the last day of a rental period.

Got notice on September 20th , to be increased from November 1st onwards

You don't need to pay the increase at all (though they did give enough notice) - the normal option for the landlord is to give you a S.21 no-fault eviction notice.

I'd suggest giving notice from now, and saying that you'll be out in 1 month - all of which would be at the old rate as you're not accepting the increase. They may whine, but ultimately it means they can try to get new tenants paying more money earlier than they would if you gave the "proper" notice ending at the end of november.

Oh, and you have the right to quiet enjoyment of your property until the end of your notice period. If the landlord plays silly whatsits trying to schedule viewings at all hours then you have the right to tell them no.

As much as the increase is frustrating I want to leave on good terms.

So I pay my rent on the first of the month in advance

Does that mean on 1st November i pay for 16 days or just pay the whole month and leave it at that?

If you give notice now and don't get any whining from your LL then just pay the 16 days. That's also the option that gives the LL what they want the fastest, which is something you may need to point out to them if there is whinging as you didn't accept the increased rent.

If I do get a comeback then I'll just agree to pay for the month as usual and leave it at that, I can't see why he would be upset by that.

be careful what you state regarding not allowing viewings. if it says in your contract you have to allow viewings during your notice period, then you have to allow reasonable viewings. if they refuse they could be held in breach of contract. There is no law that forbids a contract to allow for viewings.

You sound like a lovely tenant, from the landlords perspective, this is business, and you’ve got the flexibility to move back in and support your mother in the final moments of her life, respect.

Serve your notice on the date you’re proposing and make your move.

I've always kept my rental places top-notch and even outfitted this house with laminate with the landlord's approval of course.

I just don't want to leave a bad taste with the landlord as I want good references in the future. He hired a new property agent a couple of months back and I think this is where it all went wrong, I could argue that I was renting slightly below-market rates and now it just about over from what I see.

He's obviously got a business to run and I have my own problems, I think this works out best for all of us.

It's been a great house, the neighbours however have not been but that's a story for another time haha

Look after your mother, save on rental costs, put it towards something worthwhile.

Best wishes, don’t worry about references from estate agents, normally these are simple and just a question of did you pay rent on time? Which in your case I’m sure is yes.
